BLUE RIVER VALLEY RANCH LAKES ASSOCIATION


RULES AND REGULATIONS

Approved by the Board of Trustees May 17, 2003

1.  BUILDING:  All building plans must be submitted to the Board of Trustees for approval before starting any construction on homes, garages, additions, fences, or storage sheds.  No temporary building, outbuilding, house trailer, tent or mobile home may be erected or parked on the premises except:
          1. during construction and then not to exceed one year
         
2. on a short term, temporary basis
The Board acts as the Association’s Architectural Review Board and shall approve all plans. 

2.  FEES:  Membership fees may be set by the Trustees, subject to approval of the Membership.  This pays for all expenses of the Association.  Dues are payable to the Treasurer of the Association and must be kept current on a Monthly, Quarterly, Semi-annual or Annual basis.  A special assessment of 1.5% monthly will be charged on all past due account balances.
         
A $20.00 charge will be placed on all returned checks.  After the second returned check, all payments must be by guaranteed funds. 

3.  TRASH DISPOSAL:  A dumpster for trash collection is located by the Association’s rental cabin.  Trash is limited to normal household trash and no building materials or business materials will be permitted.  Boxes should be flattened to conserve space. All trash is to be deposited within the dumpster.  Contact Waste Management of the Rockies for disposal of any hazardous materials.
        
   Fines will be imposed for any reported violation. 

4.  MOTOR VEHICLES:  All Lots in Block 1 are private property. There shall be no trespass.  No one, other than the Owner of the Lot, may operate any vehicle, motorcycle, snowmobile, 4-wheeler or other motorized device on any Lot without the Owner’s permission.
         
All motorized or recreational vehicles should be operated sparingly prior to 8:00 am and after 9:00 pm, keeping in mind the impact on neighbors. Vehicles must adhere to the 15 mph speed limit.
         
Motorized or mechanized recreational vehicles are prohibited on the Dams or on Association property West of the Bobo Ditch with the exception of maintenance vehicles or motorized wheelchairs. No livestock, including horses, or bicycles are allowed on the Dams or on Association property West of the Bobo Ditch.

         
Motorized or mechanized recreational vehicles must stay on designated roads or established trails and are not allowed on any trail designated as “ Foot Traffic Only.”  Only Snowmobiles are allowed in the recreational area and on the hill at the end of Brook Avenue.
         
Operators of any motorized or mechanized recreational vehicles are responsible for keeping all gates closed, and any damage to livestock or property resulting from failure to do so, or from the operation of their motorized or recreational vehicle shall be the sole responsibility of the operator. 
          Operators of motorized or mechanized recreational vehicles should be respectful of the wildlife and ecology of the community and be considerate of other residents.
          Violations of these provisions should be reported to the Board of Trustees and may result in a fine (see rule #13), after notice and an opportunity for a hearing. 

5.  TRACTOR:  The Association tractor will only be operated by the individuals approved by the Board.  Usage of the tractor for individual property owner’s convenience will be free of charge for one (1) hour per year.  After that, a $15.00 per hour charge will be made to the property owner by the Association.                       

Any operator time charged will be determined by agreement between the property owner requesting the work and the operator. 

6.  FIREARMS:  The discharge of firearms, including Bow and Arrows, on Association property is prohibited. 

7. FISHING RULES

1 All people who fish must wear fishing badges: orange for owners, green for guests.
2 No live bait or minnows may be used for fishing.
3 Each Lot may have a maximum of 3 fishing guests per day.
4 Each Lot may keep up to 4 fish per day including guest’s fish.
5 Non-motorized boats are allowed on all 3 lakes.
6 Renters may fish in the South & Middle Lakes, but may not have fishing guests.
7 In the event a property is owned by 2 or more families, fishing rights will  be extended to no 
more than two members.
8 Since the South Lake gradually drains during the winter and the fish do not survive, fishermen are encouraged to keep fish after September 1st or move the fish to the middle lake.
Therefore, after September 1st worms may be used in the South Lake and there will be no limit on the number of fish kept after September 1st.
North Lake
1 Guests must be with Members at all times while fishing.   
2 Return all fish to the water immediately.
3 Single, barbless hooks only.   
4 Flies and Lures only.   
Note: Members are owners of record.
Ice fishing is permitted with the same rules as stated above.                      Revised 6-16-10


8. BEAVER/MUSKRAT CONTROL:  Control of Beavers and/or Muskrats will be accomplished by individuals designated by the Board of Trustees. 

9. SWIMMING/BOATING:  No swimming will be permitted in the lakes.  Effective May 17, 2003 non-motorized boats are allowed on the middle and north lakes.  Boats are not to be kept at the lakes.  Renters have no boating privileges.  Guests must be with a member.  This is a one year trial.  The following 2003 Colorado Boating Statutes & Regulations apply.

Regulation #212 – Personal Flotation Devices (PFD’s)

     1.  No person may operate or give permission to operate a vessel less than sixteen feet in length unless at least one Type I Life Preserver, Type II Buoyant Vest or Type III Special Purpose Water Safety Buoyant Device is on board for each person.

     2.  No person may operate or give permission to operate a vessel sixteen feet or more in length unless at least one Type I Life Preserver, Type II Buoyant Vest or Type III Special Purpose Water Safety Buoyant Device is on board for each person, plus at least one Type IV Buoyant Cushion or Ring Life Buoy, which is immediately available as a throwable device.

10. TOOLS:  Tools are for Association use only. 

11. EXPENSES:  Any expense incurred by Members which will be charged back to the Association must be approved by the Board of Trustees before such expenses are incurred.  Contractors who are hired must be approved by the Board of Trustees before commencing work. 

12. FINES:  All infractions of these Rules are subject to fines.  See the separate Fine Schedule for the fines that will be imposed by the Board.  Written notice will be sent to the offender and they will have a right to a hearing by the Board of Trustees. 

13. LAKES: No children 6 years of age or younger will be permitted around the lakes unless accompanied by an adult. 

14. CLEAN UP DAYS:  The Association “Clean Up Day” will coincide with the Silverthorne Clean Up each year, unless there are prevailing reasons why it cannot. A second yearly Work Day will coincide with the Association’s Fall Block Party, and the yearly Fall Block Party will be held the second Saturday of September. 

15. REMOVAL OF TREES & SHRUBS ON COMMON AREAS: Any altering of Common Area, which includes removal of trees and shrubs, must be approved by the Board, otherwise fines will be imposed.

LIVESTOCK RULES

Pastures: 60 acres, approximately 20 usable acres. Irrigation Rights: Two cubic feet per second

Number of Animals Allowed: 20


1.  Approval:  All livestock, horses, goats, llamas, & 4-H animals on Association property must be approved by the Board of Trustees. Our permit allows for animals only in the pasture. No pigs or chickens shall be kept on Association property.

2.  Pasture:  Animals will be kept in the fenced pasture only.  Horses may not be ridden on any property west of the Bobo Ditch.

3. Insurance:  Livestock and horse owners must accept all liability for their animals, as the Blue River Valley Ranch Lakes Association accepts no liability for injury to animals, pets, property, property owners or guests, by horses or other livestock.  Liability insurance is required: $300,000 per incident with $600,000 total aggregate per animal per incident of injury or property damage.  The policy is to be carried at the Homeowner’s expense and needs to list the Association as an entity to be notified directly by the insurer of any changes, lapses, or renewals to the policy.   (updated 4/9/2006)

4.  Grazing management: If the number of animals in the pasture exceed ten (10), then all animals will be rotated off the pasture into individual pens located behind the caretakers house. While animals are in the pens, owners will be responsible for providing hay & water. Picketing outside the pasture is not allowed as per the Conditional Use Permit.

5.  Vet Care: All horses must be vaccinated annually for Eastern and Western Influenza, encephalitis, tetanus and encephalomyelitis. All horses must also be either tube wormed annually or paste wormed every three to four months. All horses coming from out of state must also have proof of a Cogins test as complies with inter-state horse transportation laws.  Other animals must be vaccinated as required by County requirements.

6.  Manure Removal: If the number of horses in the pastures exceeds ten, and pen rotation is required, all horse owners will be responsible for at least bi-annual removal of manure, preferably in September and May. The manure will either be spread out on the pasture, removed to the dump, or used for garden fertilizer or composting.

7.  Fence Upkeep: Fence maintenance will be done by Livestock owners as needed to check for loose or sagging fence, breaks in the fence, or any other unsafe condition.

8.  Requirements of Penned Animals: If pen rotation is required, all penned horses must be fed two and one half to three pounds per one-hundred pounds of body weight of hay per horse and be provided with 15 gallons of fresh potable water daily as well as having a twelve-twelve mineral or similar salt block. Other animals must receive the same adequate feed and water.

9.  Existing Keeping Facilities: A 3 sided shed, 12 foot by 36 foot, with two, 32 foot by 22 foot pens. An enclosed tack shed, 24 foot. by 25 foot was added August 2002.

 

10. Our Livestock Agreement must be completed for all animals in BRVRLA properties.


The Blue River Valley Ranch Lakes Board of Directors passed these Livestock Rules and Regulations on August 9, 1991.  The Board reviewed and revised them on November 8, 2002.  The Board approved these Rules and Regulations on March 14, 2003.

As a legal and binding contract, failure to fulfill these regulations will result in the cancellation of the Summit County Land Use pasture permit.
